TERMS & CONDITIONS

The following terms and conditions (referred to as the Terms) apply to all purchases made from this website or by telephone with LithiumPro Energy Ltd. By placing an order you are making an offer to LithiumPro Energy Ltd (referred to as us/we/our) to purchase the items ordered subject to the Terms. The offer is only accepted when we process the order and dispatch the item(s) and once accepted by us shall constitute a binding agreement between you and us. Please therefore read this document carefully before placing your order. These terms do not affect your statutory rights.

Acknowledgement and Receipt of Orders
Orders are acknowledged by email as soon as possible. Any email or other acknowledgment from us does not constitute our legal acceptance of your order. The offer is only accepted when we process the order and item(s) dispatched. We will email you a copy of your receipt, either separately or within the acknowledgement. The receipt is confirmation that we have received your authorisation to take the monies shown from the relevant payment partner. The receipt also serves as the required proof of purchase for any returns, so please ensure you retain the email and / or a hard copy in a safe place.

Availability
With the exception of PRE-ORDER transactions. Your order for goods is subject to availability. If we do not supply goods to you for any reason we will inform you of the situation and will not charge you for those goods, or at your request we will refund any money that has already been paid by you for the goods within 24hrs (Mon-Friday).

Warranty

LithiumPro Energy is committed to providing industry-leading product quality. We offer a 5 year warranty on all of our battery products when purchased from LithiumPro energy Ltd.

From the date of purchase, we will, at our sole discretion, replace or repair defective products free of charge, including all parts and/or labour, for a period of 3 or 5 calendar years depending on the product. This warranty covers manufacturing defects or workmanship and does not cover misuse, accidental damage, or general wear and tear. The warranty includes repatriation costs should it be found to be a warranty related defect. It does not cover the cost of returning the product to us for investigation. If our investigation does not result in a warranty repair or replacement, we can send the battery back to you or offer to recycle it appropriately. We reserve the right to charge for investigation and administration costs. If we are unable to repair your battery, we will offer a suitable replacement of the same or greater specification.

Please note that the warranty will be void if the unit has been opened, suffered any physical damage or alteration internally or externally. It also does not cover damages arising from improper use, storage outside of manufacturer specifications, reverse polarity, inadequate installation, mechanical shock or deformation, contact with liquid, incorrect charging or discharging, cell damage, continuous use after a fault is detected, inappropriate environments, incorrect storage, connection terminal damage, or external electrical damage.

Limited warranty repair or replacement is at our sole discretion, and we shall not be liable for any damages, whether direct, indirect, incidental, consequential, contingent, or special damages, even if we have been advised of the probability of such damages. We retain ownership of all parts removed during the remedy, and the remedy does not extend the original warranty term. The warranty continues until the end of its term, and all remedies and measures for damages are limited to the original purchase price of the battery.

This warranty does not cover a battery that has reached its normal end of life due to general usage, which may occur within the warranty period. The lifespan of a battery depends on various factors, including application, use case, temperature, and storage environment.

We would like to highlight that our warranty does not extend to any issues related to the use and performance of Bluetooth devices or signals when using our batteries. While our batteries are designed to provide reliable power and support Bluetooth connectivity, the functionality and performance of Bluetooth connections can be influenced by several external factors beyond our control. Such as interference from other electronic devices, physical obstructions, distance, and environmental conditions.

Therefore, we cannot assume responsibility for any issues arising from the performance or range of Bluetooth devices connected to our batteries. It is important to understand that Bluetooth functionality and performance are separate from the core functions and specifications of our batteries.  For any warranty claims or inquiries related to our batteries, we are committed to addressing manufacturing defects or faults that impact the performance of the battery itself. However, any issues related to Bluetooth connectivity or signal strength fall outside the scope of our warranty coverage.  

For life support applications, we do not recommend the use of our products unless we receive written assurances that all risks have been accounted for and the customer assumes those risks, with our liability adequately protected.

All warranty claims must be made in writing to tech@Lithiumpro.co.uk, providing details of the warranty-related issue, along with attached photographs and proof of purchase. Claims must be made within 48 hours of detecting the battery fault, as continuous use during a problem can be dangerous and may void the warranty.

Applicable Law: Any contract or implied warranty shall be governed by the laws of England and Wales, unless otherwise agreed in writing.

14 Day Returns Policy 

We hope you enjoy our high quality products, however, should you wish to return a product you should notify us of your intention to do so within 14 days of the date of placing your order via email returns@lithiumpro.co.uk  and state the reason for your return and attach your original ‘Proof of purchase’.  All products must be returned in their original. UN38.3 certified packaging, with all the relevant labelling attached and supporting documentation enclosed and in the condition received them.  You must provide your ‘Proof of Purchase’ before any return can be processed for collection.  The item must not have been installed, connected or used in anyway. All batteries will be inspected for the aforementioned prior to any refunds being actioned.  Any goods returned will be at the cost of the purchaser unless the product is found to be faulty.  

All items returned must be in brand new saleable condition. Please be aware by connecting a battery to a charger for the first time will score the terminals of the battery and thus it will no longer be in saleable condition and we will not be able to refund your purchase. Please check your battery before you attempt to charge or install the battery.

Upon inspection, if the product is found to be at fault we will refund you the original purchase price during the 1st 3 month period of ownership, thereafter, we will replace the battery with a like for like model.  Your warranty term will not be affected, and the term will continue from the date of purchase.

If your returned product is found NOT to be faulty we will inform you in writing and ask you to collect your battery within the next 14 days. Alternatively, we can return your battery using our Hazardous courier service for a standard fee of £50. Should you not pay the return fee we reserve the right to dispose of your battery with no liability to you after 14 days of issuing the request for payment. 

Should your items be returned contrary to the above policy then we reserve the right to refuse to make a refund at all or we may chose, at our sole discretion, to apply a restocking charge of not less than 20% of the value of the original order, plus original hazardous carriage incurred by the seller of £50. Any Credit shall be subject to the above and buyer producing proof of purchase.

If your product is being returned as a result of an incorrect order, we will not be liable for any returns postage costs. Should you wish to use our secure, and insured hazardous returns service then a £50 fee with be deducted from any return, less any restocking fees that may apply.

When returning products we will ask you to send images of all 4 sides and the top of the product and its packaging before you return it to us. This is for your protection during the transportation process.

Lithium batteries are a Class 9 Hazardous Goods and can only be transported under very strict rules set out in the ADR regulations. Specific packaging, labelling and supporting documentation must be submitted to the carrier prior to transportation of Hazardous goods. As this is complex and can be a lengthy process we are happy to book and handle the RETURNS process for you but will charge you £50 for the administration and collection. However, this does mean the battery will be covered under our Insurance during shipping process. PLEASE NOTE: If you do decide to return ship the battery directly you will need to declare the package as Hazardous Goods Class 9. We recommend using either UPS, DHL or FEDEX as these are the only carriers that will accept Lithium Batteries. Also we advise taking their insurance to cover the cost of the batteries should it get lost or damaged during the return shipment. We reserve the right to levy a repacking/restocking fee should there be any damages to the packaging or supporting documentation. 

All refunds shall be subject to the buyer providing proof of purchase.  LithiumPro Energy will refund to you the cost of your order excluding our original delivery costs of £50 plus any subsequent collection costs, if relevant, and less any repackaging costs applicable, within 14 days of receiving the product.

Payment & Pricing

We try to ensure that all prices displayed on our website are accurate. The price for the goods will be as stipulated on the website at the time when you place your order. We may update the prices on the website at any time to take account of any increase in our costs, however caused or if, due to an error or omission, the published price for the goods on our website is wrong. The price of the goods on your order will need to be validated by us prior to processing your order. If there is a problem, we will inform you of the correct price and will give you the opportunity to purchase the goods at the correct price.
We can currently accept payment of your order by Visa, Mastercard debit or credit cards, Revolut, GooglePay, Paypal and Pay Pal Later. We do not accept Payment by cheque.  We do not offer credit facilities to trade customers.

Payment for goods must be made in accordance with our purchase procedure. All orders are positively credit card sanctioned prior to despatch. We cannot accept responsibility if any details you provide us with are incorrect or if any order is held up as a result of incorrect details supplied by you.
All prices on our website are in pounds sterling and inclusive of any applicable VAT (unless otherwise stated). Delivery is free to mainland UK is free of charge unless otherwise stated. Delivery charges for non mainland may not be included and may not be shown at the time of placing your order. (If we are unable to calculate the charges using the information supplied to us. In this case, we will contact you to discuss the delivery costs and options.)

Shipping policy

LithiumPro Energy are committed to providing industry leading product quality. Which starts from us delivering our superior product to your door.

We offer free postage as our standard delivery to addresses within mainland Britain, excluding Scotland the Highlands, Islands and offshore. Regrettably, our courier charges a premium to deliver to the following postcodes.  [IM, DG, TD, KA, MC, EH, G, PA, KA, KY, FK, PA, PH, DD, AB, IV, KW,  ZE, HS.] 

Lithium Batteries are listed as Class 9 Hazardous material and have very strict packaging, handling and transportation requirements. So there may be an additional charge for certain areas which require specialised transport. We will notify you of this when you place your order. We will endeavour to deliver the goods within the times stated at checkout – usually within 3-5 days – Next Day delivery if ordered before 2pm is not guaranteed by couriers. Nor can we  guarantee to deliver goods by a given time as we are at the mercy of final mile couriers. If no time is specified by the courier, delivery shall be within a reasonable time. 

In extreme circumstance, should delivery be delayed by us for more than 10 working days from the delivery date you have the right to contact us and cancel your order. In this case we will happily refund you any money paid for the goods.

We reserve the right to charge for re-delivery if you are not present at an agreed original delivery date. We will try to re-delivery but there will be an extra charge. Due to the cost of the items we are unable to leave them in a secure place or with a neighbour. They have to be sign for at the delivery address.

As soon as we have delivered the goods to you, you will be responsible for them. When we deliver the goods we will require you to sign for them. If you are not able to sign for a delivery, we will do our utmost to let you know when we intend to re-deliver the goods again for signature. Our responsibility for everything other than damage due to our negligence will end at the time the carrier delivers the goods to you.
Title in the goods will pass on in delivery. Should you return the goods pursuant to conditions set out under these terms and conditions, then title in the goods shall revert to us when you return the goods to us and we sign for them. 

Product Liability
The goods we sell are of a technical nature and unfortunately it is not practical to publish detailed specifications of all the goods and keep specifications 100% up to date. All drawings, descriptive matter, specifications and advertising on our website are for the sole purpose of giving approximate descriptions of the goods. However, if your goods do not conform to the specification displayed on the website relating to such goods at the date of purchase, Please notify us and we will try to rectify the issue if not we will refund you or replace the item at our absolute discretion upon production of proof of purchase (sale receipt).

Our products have been designed as auxiliary power sources, when mains power is unavailable, they are designed to supply 12v DC power. They can be connected in series with a maximum number of 4 units to increase voltage to a maximum of 48V or in parallel, also with a maximum no of 4 units to increase their capacity for use in the leisure, commercial and marine sectors. Our products have not been specifically designed for any critical safety equipment, medical equipment,  life support applications, or for use to operate critical marine navigational equipment.  We therefore do not recommend the use of our products in these circumstances, unless we receive written assurances that all risks have been accounted for and the customer assumes those risks, with our liability adequately protected.

We shall not be liable for any consequent losses, costs, damages, charges or expenses caused by any delay in delivery of the items to you.
We shall not be liable to you, for any failure or delay in performance of our contract if it is due to an event beyond our reasonable control. This includes, without limitation, acts of God, war, industrial dispute, fire, flood, tempest and national emergencies.

Miscellaneous

The contract between us shall be deemed to have been made in England and shall be governed by the laws of England and Wales.
